Georgia DUI

Even a first-offense DUI can lead to serious consequences for an offender in the City of Pembroke. You may wind up in jail, be forced to pay excessive fines, or lose your license. It is very important that you hire an experienced DUI defense lawyer as soon as possible.

Administrative Driver's License Suspension

An administrative Driver's License suspension is a different kind of suspension you could receive and may occur before you even go to court for your DUI in the City Of Pembroke. This hearing is separate from any criminal hearing (plea or trial) and is conducted by the Office of State Administrative hearings.

If you refuse to take the State administered test (either breath test, blood test or urine sample), or if you take the test and your blood alcohol level amounts to a "per se" violation, the arresting officer is required to file a report to the Department of Public Safety to initiate an administrative license suspension hearing.

First-Offense Drunk Driving Penalties

While the court has some discretion in regards to sentencing, the following penalties may apply if you are convicted of drunk driving for the first time:

Along with DUI offenses, Mr. Duncan also handles repeat or multiple drunk driving offenses as well as DUI's involving accidents that may be charged as reckless homicide or manslaughter.

NO COURT APPEARANCE

In many cases, you will not be required to appear in court.

SUPER SPEEDER LAW

The Georgia legislature has passed a "super speeder" law which could affect your driver's license and your finances negatively. Under the new "super speeder" law drivers who plead guilty to speeding at a rate higher that 14 miles per hour over the posted speed limit on interstate highways must pay two fines, one fine to the City of Pembroke and another new fine to the State, which could tack on an additional $200 fine, or face having their drivers license suspended.

NO POINTS ON YOUR DRIVING RECORD

If Mr. Duncan represents you with your City of Pembroke speeding ticket or other traffic cases, our main goal would be avoiding points on your driving record. Please note that if you simply pay the ticket that you are pleading guilty and that you are likely to receive points on your record, which would cause your insurance rates to go up and could possibly lead to your driver's license being suspended.

Duncan Law fees for representing the City of Pembroke clients depend upon the nature of the offense. As is standard practice, the client is responsible for any fines or costs imposed by the court. Legal counsel is much more affordable than you think and there is no charge for calling to inquire about fees and services.

If the court in which your case is pending is not listed on our website, please give us a call. Mr. Duncan will likely be able to help. The Law Firm of Earle J. Duncan does not represent clients with matters pending in the metro Atlanta area.
